Working together safely


As the Head of Professional Standards for the Association for Solution Focused Hypnotherapists I am passionate about promoting and upholding the highest standards in clinical hypnotherapy. I am also bound by the codes of conduct for the National Council for Hypnotherapists (NCH) and the Complementary and Natural Healthcare Council (CNHC). I hold an Enhanced DBS check and I am fully compliant with General Data Protection Regulations (GDPR) 2018.
 

Terms and conditions for face-to-face therapy should also be read in conjunction with the Covid-19 section on this website.
 

Therapy cannot go ahead without a client having read and agreed to /signed a contract of our working together. You will also be asked to declare that, to your knowledge, you have no health or wellbeing conditions that negatively impact on your being in receipt of hypnotherapy or relaxation. You will be asked to supply the name and contact details for your next of kin and your GP.
 

Our terms and conditions of working together will vary depending upon the form of therapy. Specific terms and conditions are listed below, following the Privacy Policy Statement of Intent:

PRIVACY POLICY: Statement of Intent

This policy sets out how we at Eclipse Solution Focused Hypnotherapy use and protect the information that you provide when you use our services and our website
 

It is our intention to ensure that any data you provide is managed respectfully, kept secure and only used for the purposes for which it has been provided.
 

This policy will be updated from time to time in line with prevailing legislation.
 

When you contact us via our website, phone or email we will collect your:
 Name
 Email Address
 Telephone Number
 Any information you choose to supply regarding the purpose of your enquiry.

 

What we do with this information
We use this information in order to make contact with you to discuss your requirements. We may also use this information to improve our services.


If you choose to go ahead with an appointment we will ask you to complete a referral form which asks for more information* and explains once again how we will use information provided in the course of our sessions together.


*In the referral document we will ask for:

Your name, address, telephone and email contact details so that we may contact you during the time we are working together.

  •  Your GP contact details and health information relevant for solution focused hypnotherapy treatment (individual appointments only)


  • Your next of kin: this is used very rarely and only in emergency situations (individual appointments only)


  • You may also be asked to tick a box if you wish to receive promotional/further informationabout our services or about well being in general. If you do not tick this box we will not contact you.


In the course of our sessions we will make a note of information you provide to us in order that we can plan future sessions and produce scripts which will be used in session as appropriate.
 

Under the General Data Protection Regulations which are effective from 25th May 2018 you have the following rights:

• the right to be informed (which is why we have produced this policy)
• the right of access (if you wish to see your file then please make a request in writing to Nicola Taylor. We will provide you with the information within 30 days of your request)

• the right to rectification (this is your right to request changes to any information we hold that is factually inaccurate. If you believe any of the information we hold about you is incorrect then please let us know as soon as possible and we will make the appropriate changes
• the right to erasure (given the nature of our work we are required to hold our details for a period of 7 years, after this your information will be securely destroyed)
• the right to restrict processing (we will only use the information for the purposes that we have stated: most standards of confidentiality applied in professional contexts are based upon the Common Law concept of confidentiality where the duty to keep confidence is measured against the concept of “greater good”. If in the therapist's opinion there is good cause to believe that not to disclose would cause danger or serious harm to self, the therapist or others, your GP or other appropriate agencies may be contacted. Only information required to ensure safety of relevant parties would be disclosed, Information may have to be disclosed without consent for the prevention, detection or prosecution of a crime. The sharing of anonymous case histories with supervisors and peer support groups is not a breach of professional confidentiality
• the right to data portability: we will not share your information, other than in the situations described above, without your specific consent
• the right to object (we will not contact you for marketing purposes unless you have given us specific agreement to do so)
• the right not to be subject to automated decision-making including profiling (we will not use your information for profiling purposes.

 

Sharing Data
We use a data processor for the purposes of administration (including appointment making) and accounts. The data processor is trained for GDPR purposes and fully compliant with the requirements.


Webcam Sessions
Where sessions are conducted by Webcam, eg. Skype, Facetime, the sessions are recorded only for as long as it takes to write up the notes not taken contemporaneously. Once notes have been documented, the recording is deleted.

 

Cookies
Cookies are small files which ask permission to be placed on your computer's hard drive so that we can analyse web traffic to our site. Through this we can see which of our website's pages are being viewed and are of interest. Most web browsers automatically accept cookies but you can odify your setting to decline them if you prefer. If you choose to do this you may find you cannot make full use of our website.

Solution Focused Hypnotherapy (face-to-face) terms and conditions
 

Fees :
The cost of an initial 1 hour consultation is £25. You will receive a complimentary CD for personal and private use. The CD and its contents are the copyright of Eclipse and public use and reproduction are strictly prohibited. By signing this contract you are confirming you are aware that downloads/CD should only be listened to when you
are resting and never when driving or carrying out any other activity which requires your attention.

 

Cost of Further Sessions: £50 (for 50 minutes to 1 hour) Payment is by cash or Bank Transfer.


Smoking cessation requires no initial consultation and costs £140 for a session at a duration of 90 minutes to 2 hours.
 

Punctuality :
Please ensure that you arrive on time for your appointment. If you are more than 20 minutes late it is likely that the appointment will need to be cancelled and you will be charged a cancellation fee of £15.

Cancellations :
If you need to cancel your appointment please do so as soon as possible so that a convenient time can be re-arranged. Appointments cancelled within 24 hours will be subject to a £15 late cancellation fee.

 

Guarantees :
Most clients experience positive results in a relatively short space of time with Solution Focused Hypnotherapy. Ultimately it is down to the client to engage in the therapeutic process, demonstrate willingness to change and commit to weekly
appointments. Results cannot be guaranteed.

 

Confidentiality :
All information is treated in the strictest confidence and with the utmost respect in line with General Data Protection Regulations (see privacy policy).

The right to refuse :
As a professional clinical hypnotherapist I retain the right to refuse to treat without explanation. In addition, treatment will be refused if:
o The client is deemed to be under the influence of alcohol or any other substance liable to affect the therapeutic process.
o The client engages in any behaviour deemed threatening, aggressive or abusive towards the therapist, staff at the practice centre or any other client, or appear to be a danger to themselves.
o The client presents with a condition or issue that is not suitable for treatment using Solution Focused Hypnotherapy.

 

Please be aware that in some circumstances contact with your GP can be a condition of us working together. We would discuss this at our initial consultation or as soon as you disclose information where this may become relevant. There are some conditions that are contra indicated to hypnotherapy and we would not be able to work with you under these
circumstances.

Solution Focused Hypnotherapy (online) terms and conditions

This contract details the terms and conditions of our online working relationship. If you would like to discuss any aspect of the contract please do not hesitate to call or email me.
 

What constitutes working online? 
Working online constitutes all means of remote communication with a client using digital methods or information technology regardless of whether the equipment used is a laptop, desktop, tablet, smart phone or any other device.


Insurance 
I am fully insured to work online with clients. If working with clients in countries outside of the UK I recognise that it is my responsibility to ensure adequate insurance coverage for the country in which the client is based and to be aware of and adhere to specific laws governing the practice of online therapy particularly with regards to breach of confidentiality and privacy.


Online safety (therapist) 
In order to conduct work online as safely and securely as possible I will ensure that:
 Reasonable steps are taken to ensure the suitability of the client for online therapy
 There is no physical intrusion or distraction during the session
 Our session cannot be overheard
 Our session is not left open in a browser or remain in the device ‘history’
 Electronic intrusion is prevented as far as possible using adequate firewalls and virus protection
 The security of communications platforms used is checked
 The terms and conditions of potential providers is checked to ensure that they meet the standards for healthcare and    

        working with sensitive information.

 I remain up-to-date with current and new developments regarding the security of online communication platforms.
 I receive fully informed written consent from a client before undertaking online therapy
 We have an agreed procedure in the event of an emergency (see below)
 We have an agreed procedure in the event of a technological breakdown (see below)
 Under no circumstances should the session be recorded as this constitutes a breach of security and privacy. 

Online safety (client) 
In order to receive therapy online as safely and securely as possible the client should agree to ensure that:
 The environment is suitable for the conduct of an online therapy session
 There is no physical intrusion or distraction during the session (a mobile phone should be present but remain on silent)
 The session cannot be overheard (unless client is under 18 – see below)
 The session is not left open in a browser or remain in the device ‘history’
 Electronic intrusion is prevented as far as possible using adequate firewalls and virus protection

     The security of communications platforms used is checked

 Fully informed written consent is given for online therapy
 An appropriate other (friend, family member or health practitioner) has been advised of the date, time and place of the  

        therapy session

 Provision has been made in the event of an emergency or abreaction
 There is an appropriate other present if the client is under 18
 Agree to leave the camera switched on for the duration of the session (if under 18)
 Agree that under no circumstances should the session be recorded as this constitutes a breach of security and privacy
 Agree that the therapist cannot be held responsible if they fail to follow the terms and conditions or advice for working          
together online

 

In the event of a technological breakdown 

To ensure the smooth running of the online session I will endeavour to log in to the session at least 5 minutes prior to the agreed start. If for any reason a breakdown in technology occurs we will follow an agreed process depending upon the nature of the breakdown:

 

  • Failure to achieve sound on the part of either the therapist and/or the client: as long as the picture continues the sound can be achieved via telephone and the client should expect to receive a phone call from the therapist within a reasonable time from the occurrence of the fault.

 

  • Failure to achieve an image on the part of either the therapist and/or the client: after 5-10 minutes the therapist will telephone the client to either, agree to conduct the session via telephone or to rearrange the session.

 

  • Failure to achieve either sound or image on the part of either the therapist and/or the client: after 5-10 minutes the therapist will telephone the client to either, agree to conduct the session via telephone or to rearrange the session. A full refund will be made should the client decide not to re-arrange the session.

 

In the event of an emergency

It is advisable to have another appropriate person present (in the house but not in the room unless under 18) in case of an emergency and to advise them of the time and duration of the session. Agree that the other person checks on you soon after the end of your session to ensure that full consciousness is regained after the hypnotherapy session. If living alone agree with another appropriate person or with the therapist (Nicola Taylor) that should you fail to regain full consciousness at the end of the hypnotherapy session you will receive a phone call. Should you become unwell at any point during the session your next of kin and/or your GP and/or emergency services will be contacted.

 

In the event of a breach of security or privacy

Whilst every step is taken to ensure the protection of both the therapist and client when

working online, it should be recognised that due to the nature of online work breaches of security and privacy can occur. The client can be assured that I am fully cognisant of the ICO Guidance on Data Breach Management (ico.org.uk) and adhere to their procedures/steps to be taken in the event of a breach. Following the principles of candour, I will respond promptly to advise the client of any breach in security or privacy. I will:

     • Take immediate action to limit or prevent harm.

     • Notify my Supervisor immediately.

     • Take steps to repair any harm that has been caused.

     • Take steps to prevent a repetition of the breach.

Fees :

  • The cost of an initial 1 hour consultation is £25. You will receive a complimentary download for personal and private use. The download and its contents are the copyright of Eclipse and public use and reproduction are strictly prohibited. By signing this contract you are confirming you are aware that downloads should only be listened to when you are resting and never when driving or carrying out any other activity which requires your attention.

  • Cost of Further Sessions: £40 (for 50 minutes to 1 hour)

  • Payment is by Bank Transfer

  • Payment MUST be made prior to the session.

  • Failure to pay prior to the session could lead to cancellation

 

Punctuality :

  • Please ensure that you log in on time for your appointment.

  • If you are more than 20 minutes late it is likely that the appointment will need to be cancelled and you will be charged a cancellation fee of £15.

 

Cancellations :

    • The client is deemed to be under the influence of alcohol or any other substance liable to affect the therapeutic process.

    • The client engages in any behaviour deemed inappropriate or abusive towards the therapist including inappropriate attire, surroundings or language

    • The client presents with a condition or issue that is not suitable for treatment using Solution Focused Hypnotherapy.

Health Details 

I agree to make known to the therapist:

  • Any experience of epilepsy

  • Any diagnosed mental health condition either current or in the past

  • Any instances of self-harm, attempts to take my own life or suicidal thoughts

  • Any experiences or diagnosis of psychosis

  • Any recreational drug use

  • Any current medication

Relaxation group sessions (face to face) terms and conditions

 

Fees :

  • The cost of a 1 hour session is £5. For an additional cost of £5 a CD may be purchased for personal and private use. The CD and its contents are the copyright of Eclipse and public use and reproduction are strictly prohibited. By signing this contract you are confirming you are aware that downloads/CD should only be listened to when you are resting and never when driving or carrying out any other activity which requires your attention.

  • Sessions are available on a ‘drop-in’ basis and do not need to be booked in advance.

 

Punctuality and attendance :

  • Please ensure that you arrive on time for the session.

  • As the group is advertised as ‘drop-in’ there is no need to advise of attendance/non-attendance but please be aware that this means the group may vary in number from week to week. Every effort will be made to ensure that there is suitable space available to accommodate expected numbers.

 

Cancellations :

  • If for any reason the group relaxation session needs to be cancelled notice will be given via e-mail and on Eclipse Solution Focused Hypnotherapy Facebook page.

 

Guarantees :

  • The session is for relaxation purposes only and is not intended as a ‘therapy’. It is expected that all attendees will consult with their GP to verify the suitability of attendance at a relaxation group.

 

Confidentiality :

  • All information is treated in the strictest confidence and with the utmost respect in line with General Data Protection Regulations (see privacy policy).

  • As a member of the National Council for Hypnotherapists and The Complementary and Natural Healthcare Council, I am bound by their ethical code of conduct.

 

The right to refuse :

  • As a professional clinical hypnotherapist I retain the right to refuse admittance to the group without explanation. In addition, attendance will be refused if:

    • The attendee is deemed to be under the influence of alcohol or any other substance liable to affect engagement with the group.

    • The attendee engages in any behaviour deemed threatening, aggressive or abusive towards the group facilitator, or any other attendee, or appear to be a danger to themselves.

    • The attendee presents with a condition or issue that is not suitable for attendance at a relaxation session.

 Relaxation group sessions (online) terms and conditions

 

Fees and booking :

  • Each online 1 hour session is FREE until otherwise stated and then the cost will be £5 per session

  • Sessions need to be booked in advance; please notify by e-mail, text or Facebook messenger at least 24 hours before each session

  • On receipt of booking you will be sent a link to the next session via Zoom.

 

Punctuality and attendance :

  • Please ensure that you log in on time for the session.

  • The group may vary in number from week to week however to ensure the smooth running of the group numbers will be limited to no more than 15 links (this may constitute more people if you join in with other members of your household)

 

Cancellations :

  • If for any reason the online group relaxation session needs to be cancelled notice will be given via e-mail and on Eclipse Solution Focused Hypnotherapy Facebook page.

 

Guarantees :

  • The session is for relaxation purposes only and is not intended as a ‘therapy’.

 

Confidentiality and Safety :

  • Each online session will have a password which will need to be entered in order to access the session.

  • You will have the facility to protect you own identity from others in the group by switching off the visual function on Zoom. You will still be able to see and hear me throughout the session.

  • During each relaxation session make sure that you are in a warm and comfortable place where you will not be disturbed. A mat, chair or cushion and a blanket will help to keep you comfortable. If you want to lie on your sofa you can!

  • It is not uncommon for people to fall asleep during the second half of the relaxation session and sometimes to remain sleeping once the session is over. Please make every effort to ensure that someone else in your house is aware that you are taking part and ask them to check on you 10 minutes after the session has ended. If you live alone please make provision with a friend or relative or alternatively arrange for me to telephone you after the session.

  • All information is treated in the strictest confidence and with the utmost respect in line with General Data Protection Regulations.

  • As a member of the National Council for Hypnotherapists, The Complementary and Natural Healthcare Council and as Head of Professional Standards of the Association of Solution Focused Hypnotherapists I am bound by their ethical code of conduct.

Keeping you safe during the COVID-19 pandemic

 

You can feel reassured that everything possible has been done to keep clients visiting the Abergavenny practice rooms safe whilst still feeling comfortable and cared for. A full risk assessment has been completed and terms and conditions have been updated to contain the following information:

When attending therapy sessions with Eclipse you must agree to meet the current stipulations regarding the COVID-19 pandemic:

  • As the client you must acknowledge that spending more than 15 minutes in a face-to-face session is deemed as a ‘contact’ in respect of the UK Government’s Test & Trace system (and UK devolved nation equivalents) and agree to be contacted as such.

  • As the client you must agree that your contact details may be shared with the NHS in the interests of your safety, the safety of your household and in the interests of the wider public if I (the therapist) or someone I have come into close contact with has tested positive for COVID-19. (Law in the UK permits this kind of data sharing with public health organisations in such emergencies.  https://ico.org.uk/global/data-protection-and-coronavirus-information-hub/data-protection-and-coronavirus/ )

  • As the client you must agree that if you are in a ‘moderate’ risk group, you acknowledge that this means face-to-face therapy may cause an increased risk to you if you were to become infected with COVID-19.

  • As the client you must acknowledge that if you travel for a face-to-face appointment using public transport or have a lift with anyone from outside your household that this can increase the potential risk of transmission of COVID-19.

Before we begin work together you will be asked to:

  • Submit electronic agreement in the form of an email or electronic signature PRIOR to the commencement of the first session/initial consultation

  • Declare in writing by text or e-mail:

    • That you have not experienced any COVID-19 symptoms in the past 10 days

    • That no one in your household has experienced any COVID-19 symptoms in the past 14 days

    • That you have not been asked to self-isolate as part of the Government Test and Trace program within the last 14 days
       

On arrival at the therapy room:

  • Text therapist to advise of arrival.

  • On receipt of the text the door will be opened for you.

  • The therapist will lead the way, with 2m distancing, through to therapy room.

  • All doors will be open to prevent you from having to come into contact with door handles

  • The doors will be closed by the therapist as necessary.

  • You must move straight to seating at the far side of the therapy room and sanitise hands immediately

  • The therapist will move into the room once you are seated and take seat nearest the door and sanitise hands immediately

  • Therapist and client are to remain in their respective seats until the end of the session

 

If you arrive early/late

  • Appointments will be staggered at 30-minute intervals to avoid clients meeting or having to wait with others.

  • There will be no available waiting room to minimise social contact

  • If you are running more than 20 minutes late the appointment will be cancelled and will be subject to a cancellation fee of £15

  • If you are running late the appointment will still conclude at the original time

  • If you arrive early you will not be admitted into the building until the time of your appointment

 

During sessions

  • Social distancing must be maintained at all times

  • A pillow with removable cover will be made available to you and removable cover changed between clients and placed in a sealed bag (then washed at 60 degrees prior to re-use)

  • You may request that the therapist wear a face shield

  • You may wear a face shield/mask/PPE as you deem appropriate

  • The therapy room will remain ventilated and the window open prior to the session, after the session and during the session as far as possible

 

Conclusion of sessions 

  • You will be asked to sanitise your hands at the end of the session

  • Doors will be opened so that you may leave without making contact with any door handle

  • The therapist will wipe down all surfaces that may have been touched, including all door handles, and furniture etc, prior to each session and as you leave.

 

Paying for the session  

  • All payments are to be made at least 24 hours prior to the session and by bank transfer.

  • Should you need to cancel an appointment due to Covid-19/suspected Covid-19 symptoms the fee for the session will be reimbursed in full regardless of the time of cancellation

 

Toilets  

  • There is a toilet available but it must be used only if absolutely necessary.

  • Hand washing for a minimum of 20 seconds, using soap and water to be carried out before and after using the facilities.

  • Paper towels to be disposed of in bin provided.

  • The therapist will take responsibility for wiping down all surfaces after the client has vacated the facilities.

Refreshments

  • The therapist/establishment is unable to provide any form of refreshment – tea/coffee/water

  • It is your responsibility to provide any refreshments (tea/coffee/water) you may require for the duration of the session

 

Local/national lockdown             

  • In the event of a local/national lockdown all face-to-face therapy will cease from the date of lockdown/as specified by the Government

  • You will be offered online therapy via Zoom

  • If you have pre-paid for a session and the session is cancelled due to local/national lockdown and you do not wish to move to online therapy the fee will be reimbursed in full.
